What Trust Litigation Actually Covers
Trust litigation isn’t the same as routine trust administration. It refers to legal proceedings that resolve disputes about how a trust was established, how its assets are being managed, or whether the trustee is honoring their obligations. These disputes go beyond paperwork and accounting; they often involve contested family relationships, significant assets, and accusations of misconduct.
In California, trust disputes are heard in the probate division of the Superior Court in the county where the trust is administered. For most of our clients in Fremont, that means Alameda County Superior Court’s probate division.
Types of Trust Disputes We Handle
Trust litigation takes many forms. Our attorneys handle the full range of trust-specific claims:
Trust Contests
We represent clients who challenge or defend a trust’s validity on grounds including undue influence, lack of testamentary capacity, and fraud. These claims often arise when a trust was amended shortly before the settlor’s death under circumstances that raise questions about whether the change reflected their true intentions.
Breach of Fiduciary Duty
Trustees have legal obligations to beneficiaries. When a trustee mismanages assets, engages in self-dealing, or fails to provide proper accountings, that conduct can give rise to a breach of fiduciary duty claim. We pursue and defend these matters.
Accounting Actions
Beneficiaries have the right to a formal accounting of trust assets and transactions. We pursue demands for estate and trust accounting and challenge accountings that appear incomplete or inaccurate.
Removal & Surcharge Actions
When a fiduciary’s misconduct or mismanagement has caused financial harm, we seek their removal and financial redress for the losses. We also defend trustees facing these claims.
Financial Elder Abuse
Financial elder abuse claims frequently overlap with trust and probate litigation. When undue influence over an elderly settlor appears to have shaped a trust’s terms, California law provides mechanisms to recover assets and hold those responsible accountable.
The 120-Day Deadline to Contest a Trust in California
Timing matters enormously in trust litigation. Under California Probate Code Section 16061.7, a trustee must notify beneficiaries and heirs when a trust becomes irrevocable, typically upon the settlor’s death. Once that notification is served, California Probate Code Section 16061.8 generally limits the window to bring a trust contest to 120 days from the date of service, or 60 days after receiving a copy of the trust terms during that period, whichever is later.
Missing this deadline can permanently bar a contest, even when the underlying grounds, such as undue influence or lack of capacity, are well-founded. If you’ve received a trustee notification or believe you may have a claim, don’t wait to get legal advice.
Our Approach to Trust Litigation in Fremont
Attorney Adam Allen Arant and Attorney Johanna Arant handle our trust and probate litigation matters. Their experience with these cases shapes how we approach every dispute: with individualized strategy, thorough investigation, and clear communication throughout.
Individualized Strategy & Thorough Investigation
We don’t apply a uniform playbook to these cases. Trust disputes are shaped by family dynamics, asset complexity, and the specific documents involved. We start by reviewing the trust, any prior versions, asset inventories, and relevant communications, and by interviewing witnesses. That investigation informs a strategy built around your priorities, not a generic framework.
Alameda County Probate Court Procedure
Our knowledge of Alameda County probate court procedure helps clients avoid procedural setbacks. Improperly served notices, missed filing windows, and noncompliant documents can delay or derail a case. We handle those details carefully from the start.
Settlement & Mediation
Not every dispute needs to go to trial. Where settlement or mediation can achieve a fair outcome, we pursue it. Alameda County Probate Court may require mediation for certain trust disputes, and we approach those sessions with the same preparation we bring to courtroom advocacy.
How a Trust Litigation Case Proceeds
Understanding the process helps clients make better decisions. A trust litigation matter typically moves through these stages:
- Investigation and case analysis: We review the trust and its history, gather documents, and assess the strength of your position before recommending a course of action.
- Filing the petition: If the analysis supports a claim, we file a formal petition with the probate court and give notice to all interested parties.
- Discovery: We gather evidence through interrogatories, document requests, and depositions to build the factual record.
- Mediation or settlement: Many disputes resolve before trial through direct negotiation or a formal mediation process.
- Trial: If a resolution can’t be reached, we present the case at trial with witness testimony and documentary evidence.
