Estate Taxes
Minimize or Avoid Your Estate and Gift Taxes
When planning for your Estate Tax liability, the main goal is to minimize or completely eliminate the amount of death or gift taxes your Estate will owe upon your death. Although many people believe Estate Taxes are only a concern of the wealthy, tax planning should be considered by everyone because of the uncertainty of the future changes to the IRS code and Estate Taxes.
At the Law Offices of Adam Allen Arant, located in San Jose, California, we teach our clients about how to minimize or completely eliminate their gift and / or death taxes through drafting an Estate Plan to meet your specific needs. Through a combination of certain trusts and/or gifts, you may be able to reduce the death tax liability imposed upon your estate. Through our understanding of the federal and state tax codes, we can help you with any tax implications by translating this often difficult language. Trusts as an Estate Tax Planning Tool
An Estate Tax determines the amount of money available to your family after your death. The federal government can tax that part of your estate, which exceeds $3.5 million in 2009. A trust drafted by The Law Offices of Adam Allen Arant can help minimize or eliminate the amount of taxes your estate will owe. While certain types of trusts are not appropriate for your individual situation, our firm commonly drafts the following types of trusts:
* Marital trusts, AB Trusts, Bypass Trusts, and Family Trusts
* Credit Shelter Trust
* Insurance Trust or Irrevocable Life Insurance Trust (ILIT)
* Charitable Trust
Gift Tax Exemptions
Another way people minimize or eliminate their potential Estate Tax is to give away certain property before their deaths. You may owe taxes on gifts over certain amounts in any given year. For example, in 2009 an individual can give up to $13,000.00 to a single person in any one year, and up to $1 million during their lifetime. The following types of gifts are usually exempt from any federal gift tax:
* To spouses;
* Educational or medical expenses paid directly to the institution for another person
* To certain charities or political organizations
* To an individual in a single year which do not exceed $13,000.00
